Terms of Use

1. These Terms

These Terms of Use (the "Terms") are a contract between you and Block 19 LLP, a limited liability partnership registered in Singapore ("Beach", "we", "us", "our"). They govern your access to and use of the Beach mobile app, the website at beachapp.co, and any other service we say these Terms cover (the "Service").

By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, you must not use the Service.

2. Eligibility

To use Beach you must:

• Be at least 18 years old. Beach is not available to anyone under 18 under any circumstances.
• Have the legal capacity to enter into these Terms in your jurisdiction.
• Not be barred from using the Service under applicable law or under any prior enforcement action we've taken against you.

If we learn you are under 18, we will permanently suspend your account and delete your data.

3. Your account

3.1 Creating an account

You create a Beach account by signing in with Apple or Google. You are responsible for keeping that underlying account secure. You must provide accurate information and keep it up to date.

3.2 One account per person

You may only maintain one Beach account. You may not sell, rent, loan, or transfer your account to anyone else. If we reasonably believe you are operating more than one account, we may suspend or close any or all of them.

3.3 Account security

You are responsible for everything that happens on your account. If you think someone else has accessed it, contact us at hi@beachapp.co immediately.

3.4 Deleting your account

You can delete your account from within the app. Deletion is permanent — we hard-delete your profile, posts, direct messages, and uploaded files. Messages you sent in public chat rooms remain but are stamped as from a deleted user so threads remain readable.

4. Your content and the licence you grant us

4.1 Your content stays yours

Anything you post, send, or upload on Beach — posts, comments, direct messages, photos, voice messages, GIFs you select, reports, profile details — is "Your Content". You keep ownership of Your Content.

4.2 Licence to Beach

Because Beach needs to host, display, and transmit Your Content to make the Service work, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, translate, create derivative works of, display, and distribute Your Content solely for the purpose of operating and improving the Service. For example, we use this licence to:

• Show your posts to people who follow you or share your language group.
• Deliver your direct messages to their recipients.
• If you are a Pro subscriber using voice translation, produce transcripts and translations of your voice messages via our service providers.
• Back up your content so it can be restored if something goes wrong.

This licence ends when you delete the content or your account, except that deleted content may persist in backups or tombstoned chat room messages as described in our Privacy Policy.

4.3 Your representations about Your Content

You represent and warrant that:

• You own Your Content or have the necessary rights and permissions to post it.
• Your Content does not infringe anyone's intellectual property, privacy, publicity, or other rights.
• Your Content does not violate these Terms, the Community Guidelines, or any applicable law.

5. Acceptable use

Our Community Guidelines describe what's welcome on Beach and what isn't. Those guidelines are part of these Terms. In addition, you agree not to:

• Impersonate another person, misrepresent your identity, or create an account on behalf of someone else without authorisation.
• Use Beach to send spam, chain messages, bulk marketing, phishing, or any other unwanted content.
• Harvest, scrape, or copy information about other users without their consent or use automated tools (bots, crawlers) to interact with the Service.
• Reverse engineer, decompile, or attempt to extract source code from the Service, except where expressly permitted by law.
• Probe, scan, or test the vulnerability of our systems; interfere with or disrupt the Service; or attempt to bypass our rate limits, content filters, or abuse protections.
• Use the Service for any illegal activity or to facilitate one.
• Use the Service to sell, promote, or advertise goods or services except where we explicitly allow it.

6. Reports and enforcement

If you believe another user has violated these Terms, the Community Guidelines, or your rights, please use the in-app Report feature or email us at hi@beachapp.co.

We review reports and take action we consider appropriate, which may include issuing a warning, removing content, limiting or suspending features, suspending your account, or permanently closing it. We don't promise a specific outcome for any report and we may decline to act where we judge no violation has occurred.

7. Purchases

7.1 Pro subscription and credits

Beach offers two kinds of optional purchases:

• Beach Pro — a weekly, monthly, or yearly subscription that unlocks premium features such as voice message transcription and translation.
• Beach credits — a consumable virtual currency used inside the app to do things like send chat requests or unlock hidden photos. Credits can also be earned through activity (for example, daily check-ins).

7.2 How purchases work

All purchases are processed by Apple (on iOS via the App Store) or Google (on Android via Google Play) and are subject to their terms and payment policies. We do not receive your payment credentials.

Prices are displayed in the app at the time of purchase and may vary by region, tax jurisdiction, and currency exchange rate. Apple or Google charges your selected payment method when you complete the purchase.

7.3 Subscription auto-renewal

Beach Pro subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time in your device's subscription settings (Settings → Apple ID → Subscriptions on iOS, or Google Play → Subscriptions on Android). Cancellation takes effect at the end of the current billing period; you keep Pro features until then.

7.4 Credits are non-refundable and non-transferable

Beach credits have no monetary value, cannot be exchanged for cash, cannot be transferred between accounts, and are not refundable once purchased except as required by law. Unused credits are forfeited if your account is suspended or deleted.

7.5 Refunds

Because purchases are processed by Apple or Google, refund requests must be directed to them. We cannot process refunds on their behalf, but we can help you find the right place to ask. Your statutory right to a refund under applicable consumer law is not affected.

7.6 Changes to pricing and offerings

We may change the price, features, or availability of Pro and credit products from time to time. Changes to subscription pricing will apply to your next renewal period; we will notify you before they take effect.

8. Third-party services

Beach relies on third-party providers — including Google Firebase, Amplitude, RevenueCat, Apple, Google, Google Gemini (for Pro voice translation), and Klipy (for GIFs). Your use of Beach may also be subject to those providers' terms where applicable. We are not responsible for third-party services or content, but we choose providers carefully and bind them to confidentiality and data-protection obligations. See our Privacy Policy for details.

9. Our intellectual property

The Beach name, logo, wave mark, app design, and all associated trademarks and copyrighted works are owned by Block 19 LLP. Nothing in these Terms grants you a licence to use our branding, except as strictly necessary to identify Beach when talking about the Service. You may not remove, alter, or obscure any proprietary notices we include in the Service.

10. Suspension and termination

10.1 By you

You may stop using Beach at any time and may delete your account from the app's settings.

10.2 By us

We may suspend or terminate your access to the Service, remove content, or restrict features, at our reasonable discretion, if:

• You violate these Terms, the Community Guidelines, or any applicable law.
• Your activity creates risk or legal exposure for us, for other users, or for third parties.
• You attempt to circumvent a prior enforcement action we've taken against you.
• We are required to do so by law or by a regulator of competent jurisdiction.

Where reasonable, we try to give notice and a chance to respond before taking irreversible action. In serious cases (for example, safety issues or continuing abuse) we may act immediately.

10.3 Effect of termination

When your account ends, your licence to use the Service ends too. Provisions that by their nature should survive termination — including sections on Your Content licence (to the extent content persists in backups), intellectual property, disclaimers, liability limits, indemnity, and governing law — will survive.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Beach is a platform for human interaction. We do not pre-screen user content and we are not responsible for what other users say or do. Interactions you have through Beach are at your own risk. Use common sense and keep yourself safe.

12. Limitation of liability

To the fullest extent permitted by law, Block 19 LLP and its partners, officers, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

Our total liability for any claim arising out of or in connection with the Service or these Terms is limited to the greater of (a) the total amount you have paid to us in the twelve months immediately preceding the event giving rise to the claim, or (b) SGD 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Indemnity

You agree to indemnify and hold harmless Block 19 LLP, its partners, officers, employees, and service providers from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or in connection with (a) Your Content, (b) your use of the Service in violation of these Terms, the Community Guidelines, or applicable law, or (c) your violation of any third-party right.

14. Governing law and dispute resolution

These Terms and any dispute or claim (including non-contractual disputes) arising out of or in connection with them or the Service are governed by the laws of Singapore, without regard to conflict-of-laws principles.

You and Beach submit to the exclusive jurisdiction of the courts of Singapore in respect of any such dispute, except that we may bring proceedings for injunctive or equitable relief in any court of competent jurisdiction.

If you are a consumer and live in a jurisdiction whose law gives you the right to bring a dispute under the laws of your home country or before its courts, this section does not override that right.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means before the changes take effect. Continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using Beach and may delete your account.

16. Miscellaneous

• Entire agreement — these Terms (together with the Privacy Policy and Community Guidelines) are the entire agreement between you and Beach regarding the Service and supersede any prior agreement.
• Severability — if any provision is held to be unenforceable, the remaining provisions remain in full effect.
• No waiver — our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment — you may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
• No agency — nothing in these Terms creates an agency, partnership, or employment relationship between you and Beach.
